Use in article (WP:NFCC#7) | Tuberous breasts |
Purpose of use in article (WP:NFCC#8) | In several recent discussions, I have discovered a general misunderstanding around the nature and source of (naturally-occurring) enlarged puffy nipples, which are the result of the congenital abnormality known as tuberous or tubular breasts (the subject of the article to which I intend to add this image). Adding an image of a pair of typical tuberous breasts will help alleviate confusion, educate readers, reduce stigma of the abnormality, and could have potential other beneficial impact. |
Not replaceable with free media because (WP:NFCC#1) |
Well, this image is actually a derivative of the original, in that I edited the photo dramatically to reduce any sexual connotation that might have been associated, by cropping to remove all but the breasts themselves, by enhancing lighting to mimic a medical setting, and so on. I felt that the "non-free content" option was the most accurate choice to assign the image all the same, but in truth, it is a new work derived from the original. It is not merely a screenshot. |
Minimal use (WP:NFCC#3) | It will be a top level image on a single page to show the medical condition being discussed. |
Respect for commercial opportunities (WP:NFCC#2) |
It falls pretty squarely under fair use law. The intended use of my created work is very limited. Further, the source I found for the image is itself a free alternative to the original copyrighted image, so this image is widely freely available already. Further, the original image is nearly 20 years old. Additionally, the current iteration of the website to which the copyright on the source image attributes the photo does not appear to contain the image or model in question. |
Other information | It's use is educational in nature. Since the courts have ruled an accuser must first consider whether an online item is fair use before sending a take-down notice, it is highly unlikely this largely unnoticeable edit of a previous image will ever undergo such scrutiny. |
