The image was first published in 1987, but since Dugas died in 1984, it was surely taken before then. The photo appears to have first shown to the public in this November 15, 1987 episode of 60 Minutes by CBS, however per here a TV broadcast would not have counted as the initial publication under US copyright law. Per here, the photo was published in December 28, 1987 article in People magazine where it is credited to "CBS News, 60 Minutes" but without a valid copyright notice specific to the photo. The same photo appeared in an edited form in a half-page advertisement for California Magazine in an August 23, 1988 issue of The New York Times, where it is again credited to "CBS News/60 Minutes" again without a valid copyright notice. A 2016 article by The Guardian credits the photo to "anonymous" via AP.
