Military occupation

(Redirected from Occupier)

Military occupation is a type of international legal regime where a sovereign power takes control of a foreign territory without the consent of the governed. This is often a result of war or other forms of armed conflict, and can last for varying lengths of time, from temporary occupations to long-term annexations.

Definition[edit | edit source]

The Hague Conventions define military occupation as a situation where the authority of a state is established and exercised in a foreign territory. This is achieved through the presence of military forces, who have taken control of the territory either through force or the threat of force.

Legal Aspects[edit | edit source]

Under international law, military occupation is considered a temporary situation. The occupying power does not acquire sovereignty over the occupied territory, but is granted certain rights and responsibilities. These include maintaining law and order, respecting private property, and ensuring the welfare of the local population. The Fourth Geneva Convention provides detailed rules on the treatment of civilians in occupied territories.

History[edit | edit source]

Military occupation has been a common feature of international relations throughout history. Notable examples include the Nazi occupation of much of Europe during World War II, the Soviet occupation of Eastern Europe during the Cold War, and the American occupation of Iraq and Afghanistan in the 21st century.

Criticism and Controversy[edit | edit source]

Military occupation is often controversial, with critics arguing that it violates the principle of self-determination, leads to human rights abuses, and can fuel resentment and insurgency among the local population. Occupying powers, on the other hand, often justify their actions on the grounds of security, humanitarian intervention, or the need to establish a stable government.
