On the night of his death, McClain was walking home from a convenience store, wearing a ski mask, which he wore due to anemia that made him feel cold.

The encounter began when a 911 caller reported a "suspicious person" in the area, describing McClain's appearance but stating that he did not appear to be a threat. Responding to the call, Aurora police officers confronted McClain as he walked home. The situation escalated, and officers took McClain to the ground and applied a carotid hold, a form of chokehold that restricts blood flow to the brain.
During the altercation, McClain repeatedly pleaded with the officers, saying, "I can't breathe," and expressing that he was an introvert and in pain. Despite his pleas, the officers continued to restrain him. Paramedics arrived at the scene and administered ketamine, a powerful sedative, to McClain. He suffered cardiac arrest on the way to the hospital and was pronounced dead three days later.

The initial investigation into McClain's death did not lead to criminal charges against the officers or paramedics involved, sparking outrage and demands for accountability. The case gained national attention in 2020, amid widespread protests against police brutality and racial injustice following the killing of George Floyd.
In response to public pressure, Colorado Governor Jared Polis appointed a special prosecutor to re-examine the case. In September 2021, a state grand jury indicted the three officers and two paramedics involved in McClain's death on charges including manslaughter and criminally negligent homicide.
