Disclaimers are frequently used to escape the effects of the torts of negligence and of occupiers' liability towards visitors.

Legal Use[edit | edit source]

In law, a disclaimer is a statement denying responsibility intended to prevent civil liability arising for particular acts or omissions. Disclaimers are frequently used to escape the effects of the torts of negligence and of occupiers' liability towards visitors. The courts may or may not give effect to the disclaimer depending on whether the law allows exclusion of liability in the particular situation and whether the acts or omissions complained of fall within the wording of the disclaimer.

Internet Use[edit | edit source]

On the internet, a disclaimer might be found on, for example, the "About" page of a website or at the bottom of an e-mail. For websites, a disclaimer could relate to use of the website, use of information on the website or a requirement that the viewer accept the disclaimer in order to use the website.

Medical Use[edit | edit source]

In the medical field, disclaimers are often used to provide a legal safeguard against people self-diagnosing and treating themselves with information obtained online. Medical disclaimers make it clear that the information provided is not intended to replace professional medical advice.
