No Religious Test Clause

No Religious Test Clause is a clause within Article VI, Clause 3 of the United States Constitution that prohibits the United States government from requiring a religious test as a qualification for any office or public trust.

The No Religious Test Clause was a radical and progressive provision for the time it was written. The clause was a direct response to the religious strife and discrimination that marked much of Europe's history. The framers of the United States Constitution sought to prevent such religious conflict in the United States by including this clause.

Text[edit | edit source]

The text of the No Religious Test Clause states: "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States."

Interpretation[edit | edit source]

The No Religious Test Clause is generally interpreted to mean that no federal officeholder or employee can be required to adhere to or accept any particular religion or doctrine. However, the clause is not applicable to the states, many of which maintained established churches at the time of the adoption of the Constitution.
