The Labor Standards Act (労働基準法 Rōdō Kijun Hō) is a key piece of legislation in Japan that governs various aspects of labor standards and practices within the country. Enacted in 1947, the Act aims to protect the rights of workers and ensure fair treatment in the workplace.

Overview[edit | edit source]

The Labor Standards Act sets out regulations related to working hours, wages, holidays, and other important labor-related matters. It establishes the minimum standards that employers must adhere to when it comes to their employees.

Key Provisions[edit | edit source]

Some of the key provisions of the Labor Standards Act include:

  • Regulation of working hours, including limits on overtime work
  • Minimum wage requirements
  • Rules regarding paid holidays and annual leave
  • Prohibition of child labor and discrimination in the workplace

Working Hours[edit | edit source]

Under the Act, the standard working hours are set at 8 hours per day and 40 hours per week. Overtime work is limited to a certain number of hours per month to prevent overwork and ensure the well-being of employees.

Minimum Wage[edit | edit source]

The Act also stipulates the minimum wage that employers must pay their employees. The minimum wage is periodically reviewed and adjusted to reflect changes in the cost of living.

[edit | edit source]

Employees are entitled to a certain number of paid holidays and annual leave days as specified in the Act. Employers are required to grant these days off to their employees and provide appropriate compensation.

Child Labor and Discrimination[edit | edit source]

The Labor Standards Act prohibits the employment of children under a certain age and sets out regulations to prevent discrimination in the workplace based on factors such as gender, age, or nationality.

Enforcement[edit | edit source]

The Act is enforced by the Ministry of Health, Labour and Welfare in Japan. Employers found to be in violation of the Act may face penalties and fines.
